The California Court of Appeal recently issued a favorable ruling in a case considering two important wage-and-hour rules: reporting time pay and split shift pay.
The case was first decided last year (we reported on this case on January 20, 2012). But The California Supreme Court granted review of the case, held it and eventually sent the case back to the appellate court for reconsideration.
The appellate court issued its ruling last week. Assuming this case is not granted further review, it provides significant guidance to employers in this area and provides greater scheduling flexibility for employers. However, it is only one decision from an appellate court and differs from the enforcement position of the Division of Labor Standards Enforcement.
